DMCA Policy

How to submit copyright complaints related to Pomofocus.

Vektosys respects the intellectual property rights of others and expects users of Pomofocus (https://pomofocus.vektosys.com) to do the same. This DMCA Policy describes how we respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512) and similar applicable laws.

1. Reporting Copyright Infringement

If you believe that material available on Pomofocus infringes your copyright, please send a written notice to our designated copyright contact that includes all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered by a single notice.
  3. Identification of the material that is claimed to be infringing, and information reasonably sufficient to permit us to locate the material (for example, a full URL on https://pomofocus.vektosys.com).
  4. Your contact information, including name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please use this email for copyright complaints related to Pomofocus. Incomplete notices may delay our ability to respond.

2. Our Response

Upon receiving a valid DMCA notice, we may:

  • Remove or disable access to the allegedly infringing material
  • Notify the user or publisher responsible for the material, where applicable and feasible
  • Document the complaint for our records
  • Terminate repeat infringers’ access to the Service in appropriate circumstances, to the extent access controls apply

We reserve the right to remove content that appears to infringe intellectual property rights, whether or not we receive a formal notice.

3. Counter-Notification

If you believe that material you posted or provided was removed or disabled by mistake or misidentification, you may send a counter-notification to pomofocus@vektosys.com that includes:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before removal or disabling.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, for any judicial district in which Vektosys may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of that person.

Upon receipt of a valid counter-notification, we may restore the material in accordance with the DMCA, unless the original complainant files an action seeking a court order and informs us accordingly within the statutory timeframe.

4. Repeat Infringers

In appropriate circumstances, Vektosys may limit or terminate access for users who are determined to be repeat infringers. Because Pomofocus does not require user accounts for core functionality, our ability to identify and act against specific individuals may be limited to IP-based or other technical measures, content removal, and related responses.

5. Misrepresentation

Under the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys’ fees.

6. Scope and Limitations

This Policy addresses copyright claims. For trademark, privacy, or other concerns, contact pomofocus@vektosys.com with a clear description of the issue. We may address other intellectual property concerns at our discretion and as required by law.

Pomofocus is primarily a productivity application. Much user-entered content (such as personal task lists) remains in the user’s browser localStorage and is not hosted by Vektosys. This Policy primarily applies to content that appears on or is distributed through our website and related materials we control.

7. Changes

We may update this DMCA Policy from time to time. The “Last updated” date will reflect the latest version.
